Welcome to Tutortia. These Terms of Service explain the rules that apply when you access or use the Tutortia platform, including our website, account features, tutor profiles, tutoring cases, matching features, subscription features, and related services. Please read these Terms carefully before using Tutortia.

Tutortia is owned and operated by Musintel Limited and provides an online platform for parents, adult learners, and independent tutors in Hong Kong to find and contact each other. These Terms should be read together with our Privacy Policy, Refund and Cancellation Policy, and any additional terms shown to you when you use specific features.

This introduction is intended to help you understand the structure of these Terms. The full Terms below are the binding terms that apply to your use of Tutortia.

1. Who we are

Tutortia is a platform owned and operated by Musintel Limited, a Hong Kong incorporated company.

By accessing or using the Platform, creating an account, submitting a tutoring request, creating a tutor profile, applying to a case, subscribing, or otherwise using Tutortia, you agree to these Terms.

If you do not agree to these Terms, you must not use the Platform.

3. Language and controlling version

These Terms may be provided in English and Traditional Chinese. If there is any inconsistency or conflict between the English version and any translation, the English version will control to the maximum extent permitted by applicable law.

4. The nature of Tutortia's platform

Tutortia is an online matching platform. It helps parents, adult learners, and tutors discover each other and, after mutual acceptance, exchange contact details so they can communicate directly.

Tutortia is not:

Tutors are independent users/service providers. Tutors are not employees, workers, contractors, partners, representatives, or agents of Tutortia or Musintel Limited.

Tutortia is not a party to lesson arrangements between tutors and parents/adult learners. Any lesson arrangement, including lesson time, location, format, price, payment, rescheduling, cancellation, make-up lessons, and lesson conduct, is agreed directly between the tutor and the parent/adult learner.

Tutortia does not collect lesson fees, does not hold lesson deposits, does not process tutor payouts, and does not take commission from lesson fees.

5. Account eligibility

You must be at least 18 years old to create a Tutortia account.

Tutors must be at least 18 years old.

Adult learners aged 18 or above may create their own account and submit their own tutoring requests.

For learners under 18:

You must provide accurate, current, and complete information when using the Platform and must keep that information updated.

6. Accounts, login, and security

You may sign in using supported login methods, including Google Sign-In and other authentication methods we make available.

You are responsible for maintaining the security of your account and for all activity that occurs under your account, except where the activity is caused by Tutortia's own breach of these Terms or applicable law.

You must not:

7. Google Sign-In and third-party login

If you use Google Sign-In, Tutortia may receive basic Google account information needed for login, such as your name, email address, and profile picture if provided by Google. Our handling of this data is explained in our Privacy Policy.

You are also subject to the relevant third-party provider's own terms and privacy policy when using that provider's login service.

8. WhatsApp number verification

Tutortia may require users to verify their phone or WhatsApp number. We may use Twilio Verify WhatsApp or similar providers to send verification messages and confirm that the phone or WhatsApp number belongs to you or is controlled by you.

You must not provide a phone or WhatsApp number that you do not control or are not authorised to use.

Verification of a phone or WhatsApp number does not mean that Tutortia has verified a user's legal identity, background, qualifications, safety, teaching ability, or suitability.

9. Tutor profiles and tutor obligations

Tutors may create and edit a draft profile before subscribing. A tutor subscription is required to publish a profile, appear in tutor search/directory pages, apply to cases, and receive contact disclosure after mutual acceptance.

Tutors are responsible for ensuring that all profile information is accurate, current, lawful, not misleading, and supported by appropriate evidence where relevant.

Tutor profile information may include profile photo, display name, age range, gender, education background, tutor-claimed credentials, subjects/categories, teaching formats, districts/locations, hourly rate, languages of instruction, experience, self-introduction, availability, and public activity metrics.

Tutors must not make false, exaggerated, unverifiable, or misleading claims about:

10. Tutor profile review and moderation

Tutortia may review tutor profiles before public listing. This review is for platform quality and policy purposes, such as completeness, relevance, obvious inappropriate content, misleading claims, formatting, and compliance with platform requirements.

Tutortia does not verify tutors' legal identity, degrees, schools, exam results, teaching qualifications, music grades, language qualifications, criminal record, sex-offence record, background, child-safety suitability, or teaching quality.

Tutortia does not provide a "verified tutor", "verified identity", "verified qualification", "background-checked", or similar badge.

Tutortia may edit, hide, reject, suspend, or remove any profile, case, content, or account that we reasonably believe is incomplete, misleading, inappropriate, unlawful, unsafe, low quality, or contrary to these Terms or platform rules.

If a paid tutor profile is rejected or not approved, Tutortia may allow the tutor to revise the profile until it meets Tutortia's requirements. Rejection or revision of a profile does not automatically entitle the tutor to a refund unless our Refund and Cancellation Policy says so or applicable law requires it.

11. Parent and adult learner obligations

Parents and adult learners are responsible for ensuring that tutoring requests are accurate, lawful, appropriate, and not misleading.

Tutoring request information may include learner type, school level or adult age band, subject/category, preferred lesson format, district/sub-district, budget, language preference, learning goals, and request notes.

For learners under 18, parents/legal guardians must not submit unnecessary sensitive child information. Unless Tutortia specifically asks otherwise, you should not submit the learner's full name, exact school name, exact address, HKID, child phone number, or other sensitive child identifiers.

Parents and adult learners are responsible for deciding whether a tutor is suitable. You should exercise your own judgment, ask relevant questions, request evidence of qualifications where important, supervise minors, and take appropriate safety precautions.

12. Matching and contact disclosure

A match happens only after mutual acceptance through the Platform. Examples include:

After mutual acceptance, Tutortia may unlock and make available the relevant WhatsApp contact details to the matched parties so that they can communicate directly about the specific matched tutoring purpose.

For adult learners, Tutortia may make available:

Tutortia will not knowingly make available a child's WhatsApp number for under-18 learner requests.

Contact details made available through a match may only be used for the specific matched tutoring purpose. Users must not use those contact details for spam, marketing, harassment, scraping, resale, unrelated contact, or any purpose not connected with the specific match.

Users must not pressure other users to share phone numbers, WhatsApp details, or other contact details before mutual acceptance through the Platform.

13. Off-platform communications and lesson arrangements

After WhatsApp details are disclosed, tutors and parents/adult learners may communicate directly outside the Platform.

Tutortia is not responsible for:

Tutortia may, but is not obliged to, assist, investigate, mediate, restrict, suspend, terminate, or take platform action if we receive a report about misconduct, safety concerns, false information, harassment, spam, fraud, or misuse of contact details.

14. Tutor subscriptions

A tutor subscription unlocks the ability to:

If a subscription expires or is not active:

Active tutors may have unlimited applications/matches during the subscription period, subject to fair use, anti-spam rules, platform integrity rules, and these Terms.

Tutortia does not guarantee profile approval, profile views, applications, matches, student enquiries, lesson bookings, tutor income, or any particular commercial result.

15. Pricing, trials, renewal, and payment

Current subscription prices, billing cycles, trial offers, promotional offers, included features, and renewal terms are shown on the checkout page, receipt, or account billing page. You should review those details carefully before starting a trial or purchasing a subscription.

Tutortia may offer free trials, discounted periods, launch promotions, or other promotional offers from time to time. Unless the offer terms say otherwise, you may be required to provide a valid payment method to start a trial or promotional subscription. If a trial or promotional period automatically converts to a paid subscription, the conversion timing, price, billing cycle, and cancellation deadline will be shown to you before you start.

Subscriptions may auto-renew by default through Stripe unless cancelled before renewal. Where applicable, Tutortia may send reminder notices before a trial converts or before a renewal, but you remain responsible for reviewing the subscription terms shown at checkout and managing your subscription before the relevant deadline.

Tutortia may change future prices, plans, features, promotions, or subscription terms from time to time. Price changes will not affect an already-paid current subscription term, but may apply to future renewals or future purchases, subject to any notice required by applicable law.

Payments are processed by Stripe or another payment processor we may appoint. Tutortia does not store full card numbers. You may be subject to Stripe’s own terms and privacy policy when making payment.

16. Cancellation and refunds

Cancellation and refunds are governed by our Refund and Cancellation Policy.

In summary:

If there is any conflict between this section and the Refund and Cancellation Policy, the Refund and Cancellation Policy will control for refund and cancellation matters.

17. Lesson fees and private payment arrangements

Tutortia does not collect lesson fees and does not take commission from lesson fees.

Tutors and parents/adult learners are responsible for agreeing lesson fees, payment methods, payment timing, cancellations, rescheduling, and refunds directly with each other.

Tutortia is not responsible for unpaid lesson fees, overpaid lesson fees, lesson deposits, cancellation fees, payment disputes, cash handling, bank transfer issues, chargebacks between users, or any other private payment arrangement between tutors and parents/adult learners.

18. User content

You are responsible for content you submit, upload, publish, display, or send through the Platform, including tutor profiles, tutoring requests, profile photos, descriptions, credentials, availability, rates, messages, support requests, reviews if available, and other information.

You must not submit content that is unlawful, false, misleading, discriminatory, defamatory, abusive, harassing, threatening, sexually explicit, exploitative, unsafe, spam-like, infringing, or otherwise inappropriate.

You grant Tutortia a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce, display, format, adapt, and distribute your content as reasonably necessary to operate, improve, promote, and protect the Platform. This licence ends when your content is deleted from the Platform, except where continued retention or use is reasonably necessary for legal, compliance, safety, security, backup, dispute, or legitimate business purposes.

20. Safety, safeguarding, and emergencies

Tutortia is not an emergency service and does not provide real-time safety monitoring.

For urgent safety, criminal, medical, or emergency matters, users should contact police, emergency services, or appropriate authorities directly and should not rely on Tutortia.

Users can report misconduct, safety concerns, false information, harassment, spam, fraud, misuse of contact details, or other platform abuse by emailing hello@tutortia.com.

Parents/legal guardians are responsible for taking appropriate precautions for learners under 18, including supervising lessons where appropriate, checking tutor information, choosing safe lesson locations, and deciding whether a tutor is suitable.

Tutors are responsible for acting professionally and safely, respecting boundaries, and communicating with parents/legal guardians for under-18 learners unless the parent/legal guardian expressly allows otherwise.

21. Discrimination and lawful use

Users must not use the Platform to submit, request, promote, or act on unlawful discriminatory preferences or conduct.

Tutortia may remove, edit, restrict, or reject content or requests that we reasonably believe are discriminatory, unsafe, unlawful, misleading, or inconsistent with platform rules.

22. Intellectual property

Tutortia, Musintel Limited, and our licensors own the Platform, including its design, software, branding, logos, trade names, text, graphics, interfaces, and other materials, except for user content and third-party materials.

You must not copy, modify, distribute, sell, lease, exploit, or create derivative works based on the Platform except as permitted by these Terms or by law.

You may not use the Tutortia name, logo, branding, or Musintel Limited name in a way that suggests endorsement, partnership, agency, employment, or representation unless we have given written permission.

23. Third-party services and links

The Platform may integrate with, rely on, or link to third-party websites, applications, platforms, payment services, communication services, identity verification services, hosting providers, analytics tools, error-monitoring tools, security tools, and other technical or business service providers.

Some third-party services may be visible to you when you use the Platform, such as Google Sign-In, WhatsApp/Meta services, payment services, or verification services. Other third-party services may operate in the background to help us provide, secure, maintain, analyse, and improve the Platform.

Third-party services are provided and controlled by their respective providers. They may be subject to their own terms, policies, privacy notices, fees, availability, security practices, and technical requirements. When you access or use a third-party service, you are responsible for reviewing and complying with any applicable third-party terms and policies.

Tutortia does not own or control third-party services and is not responsible for any third-party content, websites, services, products, outages, delays, errors, acts, omissions, terms, policies, privacy practices, security practices, or changes to those services.

We may change, add, remove, suspend, or replace third-party services from time to time where we consider it appropriate for business, technical, security, legal, compliance, payment, communication, analytics, or operational reasons.

24. Platform availability and changes

We may modify, suspend, discontinue, restrict, or change any part of the Platform from time to time, including features, subscriptions, pricing, directories, matching flows, moderation rules, and eligibility requirements.

We will try to avoid unnecessary disruption, but we do not guarantee that the Platform will always be available, uninterrupted, secure, error-free, or compatible with every device or browser.

25. Suspension, termination, and enforcement

We may warn, restrict, hide, suspend, terminate, or ban any user or account if we reasonably believe that the user has:

If Tutortia suspends or terminates a tutor for Terms violations, fraud, unsafe conduct, misleading information, harassment, misuse of contact details, or similar misconduct, subscription fees are non-refundable, subject to applicable law.

You may request account closure by emailing hello@tutortia.com. Account closure is subject to retention needed for legal, tax, fraud-prevention, dispute, payment, security, compliance, backup, and legitimate business purposes.

26. Disputes between users

If a dispute happens between a tutor and a parent/adult learner, users should first try to resolve it directly.

Tutortia may, but is not obliged to, assist, investigate, mediate, refund lesson fees, compensate either party, or take platform enforcement action.

Because Tutortia does not collect lesson fees and is not a party to lesson arrangements, Tutortia is not responsible for lesson fee refunds, unpaid fees, lesson quality disputes, rescheduling disputes, cancellations, lateness, no-shows, or other disputes between users.

27. Disclaimers

To the maximum extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis.

Tutortia does not guarantee:

Users are responsible for making their own decisions and taking appropriate precautions before contacting, meeting, paying, or taking lessons with another user.

28. Limitation of liability

To the maximum extent permitted by applicable law, Tutortia and Musintel Limited will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for loss of profit, revenue, business, goodwill, data, opportunity, or anticipated savings.

To the maximum extent permitted by applicable law, Tutortia and Musintel Limited will not be liable for acts, omissions, statements, conduct, lessons, payments, disputes, or arrangements of tutors, parents, adult learners, or other users.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

29. Indemnity

To the maximum extent permitted by applicable law, you agree to indemnify Tutortia, Musintel Limited, and our officers, directors, employees, contractors, service providers, and representatives against losses, liabilities, claims, costs, damages, and expenses arising from or connected with:

30. Changes to these Terms

We may update these Terms from time to time. The updated Terms will be posted on the Platform with a new "Last updated" date.

If we make material changes, we may provide additional notice where appropriate, such as by email, in-app notice, or website notice.

Your continued use of the Platform after updated Terms take effect means you accept the updated Terms. If you do not agree, you should stop using the Platform and, where relevant, cancel your subscription before the next renewal.

31. Governing law and courts

These Terms are governed by the laws of Hong Kong.

Subject to any rights you may have under applicable law, the courts of Hong Kong will have jurisdiction over disputes relating to these Terms or the Platform.
